The terms “Avangardist.pro,” “we,” “us,” and “our” include Avangardist.pro and our affiliates. This Privacy Policy explains the ways in which we collect, use, disclose, and protect information relating to our Site, applications and Services. And also applies to the processing of information about Users and other individuals that we collect when you use our Platform, which means any website, application, or services we offer, or when you communicate with us. By using the Platform or visiting the site, you accept the terms and conditions of this Privacy Policy.

1. Collection of Information

We collect different types of information from or through the Site, applications and/or Services. Where appropriate, the legal basis for our processing of Personal Data is either consent, where we ask for it, or that the processing is necessary for providing the Site, applications and/or Services and is carried out in our legitimate interests (“Use of Information” section 2).

Avangardist do not send user data to third party services except images. It only receives profile data from Google and Facebook user accounts.

Account Information: When you sign up for an Avangardist.pro Account, you select a User ID (by entering an email address and password) and we collect and store that information. Collected information is data we have solicited in a form or obtained via cookies or by other means; stored information is collected information that has been subsequently deposited into our databases after collection. In addition to your User ID, we also collect and store your first name and last name. We may also collect and store your company name, telephone number, address, and certain other information about you that may be required by us to provide the Services or be disclosed by you during your use of the Services.

Billing Information: When your Account includes a Subscription, we collect, but do not store, your credit card number. When you enter your credit card number, it is sent directly into our Third Party payment provider and bypasses our databases entirely. You agree that our Third Party payment providers and processors may collect and store your billing address and credit card information on our behalf, and that we may change our payment provider and processor at any time for any reason.

Avangardist.pro will collect and store your billing address. Full credit card numbers are never visible to Avangardist.pro employees or contractors, and we will not modify your credit card number or billing address under any circumstances. We adhere to all controls required for handling cardholder data in accordance with Payment Card Industry (PCI) compliance standards. You agree that our Third Party payment processors may collect and store your billing address and credit card information on our behalf. We only use Third Parties providing sufficient guarantees to implement appropriate technical and organizational measures.

Log Data: When you use the Services, our servers may automatically collect and store information, including information that your browser sends whenever you visit a website. This log data may include, but is not limited to, your Internet Protocol (IP) address, the address of the web page you visited before using the Services, the operating system you are using, the date and time of your accessing the Services, geolocation information, type of device, cookie data, and browser signatures.

IP Addresses: We will log the IP address of any visitor to a webpage you create and publish using the Services in order to calculate traffic usage per Account and conversion rates per variant, investigate spam allegations and discrepancies in page statistics, as well as to ensure the security of the webpage, Services, and related data. Avangardist.pro never uses the IP address or other Personal Data of visitors to your pages to conduct marketing activities or promote the Services.

Cookies and Log Files: Cookies are small amounts of data that are transferred to your web browser by a web server and are used to collect and store information about a user. The ways we use cookies include, but are not limited to: tracking which webpage variant a visitor has seen, monitoring traffic patterns, and gauging the popularity of service options. Cookies also allow us to ensure that visitors see the webpage variant they expect to see if they return to the same website URL, and to calculate total visits and views per webpage, variant, Account, and client sub-account. First-party cookies on Avangardist.pro landing pages are anonymous and cannot be used on their own to identify an individual.

Use of the Site and Services signifies consent to Avangardist.pro’s use of cookies, including and without limitation Third Party cookies that Avangardist.pro may choose to use for analytics or other purposes. You agree that should you disable cookies on your browser, certain aspects of the Services may be unavailable to you, and that Avangardist.pro is not responsible for any adverse effects arising from your browser or other computer or mobile settings. You agree that you are responsible for adhering to all laws, policies, and other regulations in your relevant jurisdiction(s), including but not limited to all laws requiring that cookie use must be disclosed. Avangardist.pro disclaims all liability in this area.

User Contributions: You may also provide information to be published or displayed on public areas of the Site and/or Services, or transmitted to other users of the Site and/or Services (collectively, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. We cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Lead Data: You have the option of using the Avangardist.pro platform to build forms and solicit information from individual data subjects (“Lead Data”). In these situations, since you choose which data to collect and process, the nature of the data, as well as the purposes and means of processing, you are acting as “Data Controller” under applicable laws (including, but not limited to, the General Data Protection Regulation (“GDPR”)) and you have the associated responsibilities under these applicable laws.

By maintaining an Account with us, you voluntarily consent to the collection, storage, use, and disclosure of Personal Data as specified in this Privacy Policy. Without limiting the foregoing, we may on occasion ask you to consent when we collect, store, use, or disclose your Personal Data in specific circumstances. These circumstances may include, but are not limited to, Trial Programs, Beta Tests, research and development, and other changes, updates, or additions to the Services.

2. Use of Information

Generally, we use information about you to operate, improve, promote, and protect Avangardist.pro and our Platform, communicate with you and personalize content. This includes, but is not limited to, the right to conduct research, analyze trends, monitor traffic usage, and examine the ways in which our users engage with the Services.

We may use your Personal Data to respond to your questions or comments, including support-related and billing inquiries. We also use your Account data to administer your Account and keep track of billing and payments, invoicing, and Account management.

2.1. Operating our Platform

We may use information about you described above for various business purposes related to operating our Platform, including to:

1.Provide, maintain, and improve our Platform, including to process transactions, develop new products and services (for example, including you in tests or pilots of new or revised Platform functions, such as messaging or search functionality or using information about your usage of the Platform to develop new or revised messaging or search functionality), and manage the performance of our Platform;

2.Display information about you, for instance, your list of interests, which will be visible on your profile;

3.Personalize the Platform, for example, to suggest content in which we think you may be interested;

4.Allow you to share information about your use of the Platform through a third-party social media service, if you connect your account through that service (which you can turn off at any time) and to provide you with better recommendations;

5.Monitor and analyze trends, usage, and activities in connection with our Platform;

6.Detect, investigate, and prevent fraudulent transactions, abuse, and other illegal activities; to protect the rights, property, or safety of Avangardist.pro and others; to enforce compliance with our policies; and to comply with applicable law and government requests; and

7.Perform accounting and administrative tasks, and enforce or manage legal claims.

2.2. Communicating With You

We may use information about you for various business purposes related to communicating with you, including to:

1.Respond to your comments, questions, and requests, and provide customer service;

2.Communicate with you, in accordance with your account settings, about products, services, and events offered by us and others, to provide news and information that we think will be of interest to you, to conduct online surveys, to contact you about events on our Platform that are being held near your location, and to otherwise communicate with you in accordance with Section 2.3;

3.Notify you about communications of other members, in accordance with the communication preferences that you indicate in your account; and

4.Send you technical notices, updates, security alerts and support, and administrative messages.

2.3. Advertising And Other Uses

We may use information about you for various other business purposes, including to:

1.Provide content, features, or sponsorships that match member profiles or interests;

2.Facilitate contests and other promotions;

3.Send you marketing communications, subject to applicable law;

4.Combine with information that we collect for the purposes described in this Privacy Policy; and

5.Carry out any other purposes described to you at the time that we collected the information.

2.4. Legal Basis for Processing

If you are in a jurisdiction that requires a specific legal basis for processing personal data, our legal basis for collecting and using the information described above will depend on the type of information and the specific context in which we collect it.

1.We process information about you in order to provide our services in accordance with our Terms of Service, for example, to allow you to join groups or to display your profile to other members; to allow us to send you important service updates; and to perform a contract.

2.We also process information about you where it is in our legitimate interests to do so and not overridden by your rights (for example, in some cases for direct marketing, fraud prevention, network and information systems security, responding to your communications, the operation of networks of groups by the network administrators, and improving our Platform).

3.Sometimes you provide us with sensitive information about you; for instance, the mere fact of joining a certain group may indicate information about your health, religion, political views, or sexual identity. Joining such groups or posting information on the Platform about these topics is entirely voluntary and, depending on the settings of the group and your profile (e.g., public or private), our legal basis for processing any sensitive information is either that you manifestly make it public or your explicit consent.

4.In some cases, we may also have a legal obligation to process information about you, or may otherwise need the information to protect your vital interests or those of another person. For example, we may process information, if we believe doing so is required by, or in accordance with, applicable law, regulation, legal process, or audits. We take steps designed to ensure that only those employees who need access to your Personal Data to fulfill their employment duties will have access to it.

If you have received a commercial electronic message (CEM) from us (regarding our products, services, news and events), you have the option not to receive this CEM. We provide an opt-out function within all electronic marketing communications, or will cease to communicate with you for this purpose if you email us at support@avangardist.pro and tell us not to communicate this information to you.

While you maintain an Account with us, we may contact you to notify you about changes to the Services, and other important Service related notices, including but not limited to security and fraud notices, Service suspensions, and outages. These emails and messages are considered essential, non-marketing communications, and you may not opt-out of them.

We work hard to keep the Services secure and to prevent abuse and fraud. We may use your Personal Data as necessary to respond to security incidents, claims of any violation of our rights or those of any Third Parties, to protect the rights, property, or personal safety of you, us, our Customers, and the public, and as required or authorized by law.

3. Disclosure of Information

Avangardist.pro will only share your information with Third Parties in accordance with your instructions or as necessary to provide you with a specific service (for example, our Third Party payment processors) or otherwise in accordance with applicable privacy legislation. As a general rule, unless permitted in this Privacy Policy, we do not and will not sell, rent, share, or disclose your Personal Data without first receiving your permission. When we disclose your Personal Data to Third Party service providers, we take reasonable measures to ensure that the rules set forth in this Policy are complied with.

This policy is not intended to place any limits on what we may do with data that is aggregated and/or anonymized so it is no longer associated with an identifiable Customer or user of the Services (“Aggregated Data”). We may use your Personal Data to generate Aggregated Data for internal use and for sharing with Third Parties on a selective basis.

Please note that your Personal Data may be stored and processed in any country where we have facilities or in which we engage Third Party service providers. By using the Site and/or Services, you consent to the transfer of information to countries outside your country of residence, including the United States, which may have different data protection rules than in your country. While such information is outside of the EU/EEA, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. 4. Your Data Rights

3.Opting out from receiving marketing communications that we send you at any time. You can exercise this right by selecting the “unsubscribe” or “opt-out” link in the marketing emails we send you. Additionally, you may update your email preferences by changing the settings in your account.

4.Withdrawing your consent at any time if we have collected and processed your information with your consent. Withdrawing your consent will not affect the lawfulness of any processing that we conducted prior to your withdrawal, nor will it affect processing of your information conducted in reliance on lawful processing grounds other than consent.

We will maintain your Personal Data for as long as they are needed, or as required by applicable laws, regulations, or government orders. Unless you request otherwise, your Account, including Lead Data, will be deleted from our databases within twelve (12) months of Account cancellation. We reserve the right to charge a fee for data retention past our prescribed deletion period, and to update or amend our data retention policy.

Note that Avangardist.pro is a controller of your information. Other members, such as group organizers and network administrators, may also act as controllers of your information. You should contact these members if you have any questions about how they use information that you have provided to them.

5. Links to Other Sites

The Site and/or Services may contain links to other websites. We are not responsible for the privacy practices or the content of such websites. We encourage you to read the privacy policy and terms of use of any linked websites, as their policies and practices may differ from our own.

6. Security

We employ technical and organizational measures designed to protect your information that is under our control and that we process on your behalf from unauthorized access, collection, use, disclosure, copying, modification, or disposal, both during transmission and once we receive it. We store all information that you provide to us on servers on which security controls are used. We train employees regarding our data privacy policies and procedures, and authorize employees to access personal information as required for their role. We use firewalls designed to protect against intruders and test for network vulnerabilities. However, no method of transmission over the internet or method of electronic storage is completely secure.

We will strive to prevent unauthorized access to your Personal Data, however, no data transmission over the Internet, by wireless device or over the air is guaranteed to be 100% secure. You should better prefer private network to connect to our services. We will continue to enhance security procedures as new technologies and procedures become available.

Where you have a password, which enables you to use our services, you are responsible for keeping this password complex, secure, and confidential. If you would like to update or change your password, you may select the “Forgot password?” link on the login page. You will be sent an email that allows you to reset your password. At no time is an Avangardist.pro employee able to view your password.

Please remember that you control what Personal Data you provide while using the Site and Services. Ultimately, you are responsible for maintaining the secrecy of your identification, passwords and/or any Personal Data in your possession for the use of the Site and/or Services. Always be careful and responsible regarding your Personal Data. We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the Personal Data you provide to others through the Site or Services. Similarly, we cannot assume any responsibility for the content of any Personal Data or other information which you receive from other users through the Site or Services, and you release us from any and all liability in connection with the contents of any Personal Data or other information which you may receive using the Site or Services. We cannot guarantee, or assume any responsibility for verifying, the accuracy of the Personal Data or other information provided by any Third Party. You release us from any and all liability in connection with the use of such Personal Data or other information of others.

7. Children’s Privacy

The Site and/or Services are not directed to children under the proper legal age (16 year old mostly, but it can change dependently or your jurisdiction), and we do not knowingly collect Personal Data from children under the proper legal age without obtaining parental consent. If you are under the proper legal age, then please do not use or access the Site and/or Services at any time or in any manner. If we learn that Personal Data has been collected on the Site and/or Services from persons under the proper legal age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the proper legal age has provided Personal Data, then you may alert us as set forth in the “Support” section and request that we delete that child’s Personal Data from our systems.
